Legal Disclaimer

In this Disclaimer, capitalised words and expressions used but not defined shall have the meanings given to them in the Rules.

The Platform, any communication by or on behalf of Us, and the information contained therein, is directed only at persons who are eligible to create an Account and Enter Games. They are not meant to entice or encourage Participants who do not meet Our eligibility criteria to Enter Games and are not an offer or invitation by the Manager to any person to do so.

By accessing the Platform, registering for an Account and/or Entering Games, You acknowledge that You are responsible for ensuring that it is legal for You to create and/or access Your Account and/or Enter Games in the jurisdiction in which You are physically located when transacting with Us. We are not liable to pay a Prize to any Participant in respect of any Entry which occurred whilst the Participant was physically located in a jurisdiction in which such Entry is unlawful.

We make no warranties, guarantees or representations, of any kind, express or implied, as to the accuracy, availability, completeness, suitability or reliability of the Content and information contained on the Platform or other communications sent by or on behalf of Us for any purpose. Any reliance placed on such information is strictly at Your own risk.

The Manager and its officers, members and employees accept no liability for loss or damage (including, without limitation, indirect or consequential loss or damage or other losses or damage of whatever kind) that arise out of, or in connection with the use of the Platform or reliance on the contents. By accessing the Platform, You agree that You will not bring any claim against the Manager, its officers, members or employees in respect of any losses which You suffer in connection with the Platform.

By using the Platform, You expressly agree that use is at Your sole risk. We do not warrant that the Platform will be uninterrupted or error free. Under no circumstances, including but not limited to negligence, shall We, Our Managers, officers or employees or any other parties involved in creating, producing, or delivering the Platform be liable for any damages whatsoever (including, without limitation, any direct, incidental, consequential, indirect, or punitive damages) arising out of or related to Your access to, use of, or inability to access or use the Platform, or other locations accessible through the Platform, even if We have advised of the possibility of such damages.

If any provision of this Disclaimer is, or is found to be, unenforceable under applicable law, it will not affect the enforceability of the other provisions stated within this Disclaimer.

The Platform operates under the laws of the INDIA and any disputes and / or any legal proceedings will be heard in the Indian Courts.

Syndication Members

We disclaim any and all liability, including any express or implied warranties, whether oral or written to any Syndicate Members. By Entering Games, You acknowledge that no representation has been made by Us that We shall be responsible for or have any liability whatsoever for any purported claim from a Syndicate Member. For the avoidance of doubt, We will only be liable for any valid claim made by the registered holder of the Account with the winning Entry.

Where a Participant Enters Games with the intent of sharing a Prize with Syndicate Members, the Participant is:

Deemed to be the Participant for the purposes of the Rules; and

Is not acting as Our agent for that purpose, and We shall not be:

Liable for the payment of any Prize to any Syndicate Member other than a Prize emanating from a winning Entry which is payable only to the to the registered holder of the Account with such winning Entry; and

Bound by any agreement between the registered holder of the Account and any Syndicate Member.

Hyperlinks

The Platform and other communications may contain hyperlinks to other websites which are not under the control of the Manager. In addition, third party websites may contain hyperlinks to access the Platform. We have not reviewed and accept no responsibility for any information held on any other third party websites that are accessed via a hyperlink, or from which the Platform is referred to, or accessed by a hyperlink. A hyperlink does not constitute an endorsement of the content, viewpoint, accuracy, opinions, policies, products, services or accessibility of any other third party website. The Manager and its officers, members and employees accept no liability for loss or damage (including, without limitation, indirect or consequential loss or damage or other losses or damage of whatever kind) that arise out of, or in connection with access to, or the use of, any third party website linked by a hyperlink from, or to the Platform, or any information contained on a third party website. We cannot guarantee that the controller of any third party website will comply with privacy standards and practices to the same degree as Us.

Third Party Sales Channels

We disclaim any and all liability, including any express or implied warranties relating to the sale of any products and services, through approved Third Party Sales Channels. We cannot accept any responsibility for any information held and the processing thereof (including payment of prizes) via any other third party sales channels and their associated websites.

Viruses

We make no warranty or representation that the Platform or communications will be compatible with all systems, or devices, or that they will be secure. Whilst We exercise all reasonable skill and care to ensure that the Platform and communications are secure and free of errors, viruses and other malware, Participants are strongly advised to take responsibility for their own internet security, that of their personal details and their devices and computers. We accept no liability for any loss or damage resulting from a virus or other malware, a distributed denial of service attack, or other harmful material or event that may adversely affect Participant’s hardware, software, data or other material that occurs as a result of use of the Platform or any other site referred to on the Platform.

Altering of Forms

Unauthorised attempts to upload information or change information contained on the Platform, including unauthorised alterations to the wording of any online forms available on the Platform is strictly prohibited and may render the form or information invalid.

Intellectual Property

Intellectual property, including trademarks and logos used on the Platform and communications are either licensed to, or the property of, the Manager. No data, file, graphics, images, results or other Content on the Website, Mobile App or communication may be reproduced or distributed unless expressly permitted by the Manager.

Acknowledgement

Users of the Platform are taken to have read, understood and agreed to be bound by this Legal Disclaimer.
